Terms of Service

OnRecord is a free, entertainment-focused college football community where fans pick a school, make predictions (“calls”) about games, post opinions (“hot takes”), and build a reputation based on a points-only scoring system.

OnRecord is not a gambling or sports-betting service.No real money is wagered, deposited, paid out, or won. Points and “receipts” have no cash value and cannot be redeemed for anything of monetary value. All predictions are for entertainment and bragging rights only and are not betting or financial advice.

You must be at least 13 years old to use OnRecord. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements and that you are not barred from using the Service under any applicable law.

• You are responsible for the information you provide and for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account.
• One person may not maintain multiple accounts to manipulate scoring, voting, or reputation.
• Notify us promptly at support@onrecord.gg if you suspect unauthorized use of your account.

You agree not to use the Service to post, share, or do any of the following:

• Harassment, bullying, threats, hate speech, or content that targets people based on a protected characteristic.
• Impersonation of any person or organization, or misrepresenting your affiliation.
• Content that is illegal, fraudulent, obscene, or sexually explicit, or that exploits or endangers minors.
• Spam, scams, or unsolicited promotion.
• Content that infringes anyone’s intellectual property, privacy, or other rights.
• Attempts to cheat, manipulate, or game the scoring, voting, leaderboard, or reputation systems.
• Scraping, automated data collection, reverse engineering, or interfering with the Service’s operation or security.

You retain ownership of the content you post (your takes, comments, calls, images, and any other material, together “User Content”). By posting User Content, you grant OnRecord a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, adapt, and promote your User Content in connection with operating and marketing the Service.

You represent and warrant that you own or have all necessary rights, permissions, and consents to your User Content, including the rights of any identifiable people, brands, or works it contains, and that your User Content does not violate these Terms or any law.

OnRecord is built around content being “on the record.” You understand that graded calls and other User Content may be retained, displayed publicly, and treated as a permanent part of your record even after you stop using the Service, subject to the deletion rights described in our Privacy Policy.

OnRecord may remove content or suspend or terminate accounts at its sole discretion, with or without notice, for any violation of these Terms or for any other reason. We are not obligated to monitor User Content, but we may review and act on reports.

The Service, including its design, branding, logos, and software, is owned by OnRecord and protected by intellectual property laws. Except for your own User Content, you may not copy, modify, or distribute any part of the Service without our permission.

Team names, logos, conference names, and related marks are the property of their respective owners. Sports scores, schedules, and betting lines are provided by third-party sources. OnRecord is not affiliated with, endorsed by, or sponsored by the NCAA, any conference, any school, ESPN, or any other organization, and we do not guarantee the accuracy, completeness, or timeliness of any third-party data.

We respect intellectual property rights and respond to valid copyright notices under the DMCA. If you believe content on OnRecord infringes your copyright, follow the process in our DMCA Policy or contact support@onrecord.gg. We may remove infringing material and terminate the accounts of repeat infringers.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any scores, lines, gradings, or other data will be accurate. Nothing on OnRecord is betting, gambling, or financial advice.

To the fullest extent permitted by law, OnRecord and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US $100).

You agree to indemnify and hold harmless OnRecord and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time as described in Section 6. Provisions that by their nature should survive termination (including content license, disclaimers, limitation of liability, and indemnification) will survive.

We may modify or discontinue the Service, and we may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and may provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first try to resolve the dispute informally by contacting us at support@onrecord.gg. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Texas, and you consent to their jurisdiction.

If any provision of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale. These Terms, together with our Privacy Policy and Community Guidelines, are the entire agreement between you and OnRecord regarding the Service.
